1. Acceptance of Terms

By accessing or using Herp-Ops ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

2. Description of Service

Herp-Ops is a reptile care management platform that allows users to:

  • Track and manage reptile collections
  • Log feeding schedules and history
  • Record health information and veterinary visits
  • Track weight and growth over time
  • Set up care reminders and notifications
  • Store photos and documentation
  • Manage feeder insect inventory

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

4. Subscription Plans and Payment

4.1 Free and Paid Plans

Herp-Ops offers both free and paid subscription plans. The features available to you depend on your subscription level. We reserve the right to modify features included in each plan.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Payment is processed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide refunds for partial billing periods, except as required by law.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for any illegal or unauthorized purpose
  • Harass, abuse, or harm other users
  • Upload content that is offensive, obscene, or inappropriate

6. User Content

You retain ownership of all content you upload to the Service ("User Content"), including reptile information, photos, and notes. By uploading User Content, you grant us a limited license to store, display, and process that content solely to provide the Service to you.

You are responsible for ensuring you have the right to upload any content and that your content does not violate these Terms or any applicable laws.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Herp-Ops and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Important: Herp-Ops is a tracking and management tool. It is not a substitute for professional veterinary advice. Always consult a qualified reptile veterinarian for health concerns about your animals.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERP-OPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Herp-Ops and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Account Termination

You may delete your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users.

Upon termination, your right to use the Service will immediately cease. We may retain certain information as required by law or for legitimate business purposes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
